GENERAL TERMS AND CONDITIONS OF CUSTOM VACATION PACKAGES

PREAMBLE

GreekExperience.Travel is a division of A.G.E. Travel Group S.A.

The Terms and Conditions below govern the relationships and agreements between our company and its clients for custom-designed  (bespoke) vacations.

We strongly advise anyone visiting our web site to carefully read these Terms and Conditions along with our website Terms of Use prior to making any use of our websites and before booking any of our packages.

Any person or entity accessing our site and/or booking one of our packages agrees to be fully and irrevocably bound by these Terms and Conditions.

These terms are unilaterally being modified, updated or terminated by A.G.E. Travel Group at its sole discretion.

DEFINITIONS

“We” are Ancient Greek Experience S.A., trading name “A.G.E. The “Travel Provider” is any third party providing products, services or facilities as part of our custom vacation Packages.

The “Service” is any service included within a custom vacation package.

The vacation “Package” is a combination of vacation services offered from various providers. Clients will receive all essential information about an offered Package before concluding a vacation contract with us.

“You” are any person or legal entity accessing or using our websites and/or inquiring or buying a custom vacation Package from us.

TERMS AND CONDITIONS OF SERVICE

OFFERED PACKAGES

To ensure that your itinerary is tailored to your specific needs, we’ll first collect information about your interests and preferences. We’ll then use this information to create an itinerary that includes hand-picked hotels, activities, and a detailed schedule for each day of your trip. You’ll also receive a map for each day and suggestions for restaurants if needed.

The cost of the itinerary will include everything mentioned as being part of it, from your private transportation to the exact hotel room you’ll be staying in.

All prices are quoted in Euros, which is the only currency accepted.

BOOKING & PAYMENT TERMS

Payments are effected by wire transfer at our designated international bank account number or by credit or debit card. Additional charge for card payments is 3% on total invoice value.

Every person ordering one of our packages shall accurately provide all information required. For card payments, the name of the cardholder should match the name of the traveler. If otherwise, the person booking the custom package shall mention the difference in the respective booking form. We reserve the right to accept or reject such booking at our sole discretion.

Payment Terms:

  • 30% deposit at the time of confirmation.
  • Final balance paid at least 60 days prior to arrival.

Once you submit your order and your payment is accepted by our online payment system, your credit card will be charged and your order will be confirmed by e-mail without undue delay.

You will be able to store and reproduce your order details and these Terms and Conditions for your reference.

If the selected vacation package is cancelled or non-realized and the refund terms are satisfied, the refund will be effected up to two weeks after its request.

CANCELLATION / TERMINATION POLICY

Cancellations are subject to the following penalties of the full Package price:

  • 30% deposit is not refunded in any case.
  • 60-46 days prior to arrival: 50% penalty
  • 45 or less prior to arrival: 100% penalty

You may also cancel without paying any penalty in the event of exceptional circumstances due to force majeure which are likely to affect the Package, including for example warfare, terrorism, significant risks to human health such as the outbreak of a serious disease at the travel destination, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the destination or participate in Package as agreed in the contract.

We may terminate the Package contract and provide you with a full refund of any payments made for the Package.

We shall not refund or compensate you for any termination attributed to you or to a person other than the Travel Providers.

ALTERATIONS

Before the start of the Package, we reserve the right to unilaterally change the package itinerary or travel contract terms if the change is insignificant and we inform you of the change in a clear, comprehensible and prominent manner by e-mail. You are responsible for providing us with up-to-date and accurate contact details in order for us to keep you informed of any changes to the Package.

We retain the right to substitute hotels with those of similar or higher quality up to 24h before the start of the Package or to make other changes in the itinerary of similar or higher quality. In any such case, we will notify you be e-mail.

Any special client requirements and requested alterations should be notified to us in writing at least 60 days before the start of the package. We will review them and reply whether they are accepted or not.

ASSIGNMENT

You may transfer the package to another person who satisfies all the conditions applicable to that contract, after giving us at least 7  days notice on a durable medium.

The transferor of the package travel contract and the transferee shall be jointly and separately liable for the payment of any balance due and for any additional fees, charges or other costs arising from the transfer. Those costs shall not be unreasonable and shall not exceed the actual cost incurred by us due to the transfer of the package travel contract.

TRAVEL AND MEDICAL INSURANCE

We strongly recommend that you are properly and adequately insured prior to the start of the Package. Insurance must also cover your potential hospitalization and/or repatriation costs.

PASSPORTS AND ENTRY VISAS

We can advise you on passport and entry visa requirements but it remains your sole responsibility to meet all official travelling and entering requirements. Your name provided to us should be the same with the name appearing on your passport.

HEALTH AND SAFETY

All of our Travel Providers are legally and contractually bound to always comply with all applicable health & safety regulations, including Covid-19 health protocols enforced by law.

SPECIAL CONDITIONS

Upon booking you must advise us in writing of any condition which may limit your participation in any of our activities or require special treatment or professional attention during the execution of the Package in which you intend to participate.

LIMITATION OF OUR LIABILITY

By participating in one of our Packages you agree to always follow the instructions of our appointed tour leaders and other representatives who reserve the right to refuse participation to anyone exhibiting unsafe or offensive conduct or manner.  In such cases, we shall not be liable for any consequences to you and we may also apply full cancelation charges.

By participating in one of our Packages you understand that holiday activities may be tiresome and carry inherent risks which may cause some inconvenience to you. Although we will do everything possible for your comfort and enjoyment, we will not be liable for any discomfort and inconvenience caused to you by Package activities.

We shall not be liable to you for any unfortunate events, unforeseen costs or damages of any kind arising out of or in connection with the implementation of our Packages unless they are directly caused by our gross negligence or willful intent.

We shall not be liable to you if we are unable to implement any or all of the agreed parts of the Packages due to exceptional circumstances caused by force majeure including, but not limited to, warfare, acts of terrorism, outbreak of a serious disease at the travel destination, or natural disasters such as floods, earthquakes or adverse weather conditions.

In any case, our liability to you is limited up to the maximum extent allowed by applicable law.

COMPLAINTS

If you are unhappy with any aspect of your Package and wish to complain, then please raise this promptly with us as well as with the relevant Travel Provider. We will both do our best to rectify the issue without delay. In general, complaints should be lodged only in writing via email no more than 14 days after your travel Package has finished. You are required to attach receipts and evidence to substantiate your claim. Please note that we will not accept any claim lodged 15 or more days after completion of the Package.

PART 3. OTHER TERMS AND CONDITIONS

We may modify, update or delete any of these Terms and Conditions anytime and at our sole discretion.

Any agreement or modification of an agreement between us shall be valid only if confirmed by both parties in writing.

All provisions in these Terms and Conditions are severable. In the case where a competent Court of Law determines that any of these provisions is illegal, invalid or unenforceable, the remaining provisions shall still remain in full force and effect.

ALTERNATIVE DISPUTE RESOLUTION

 

You agree to try to negotiate on any dispute which may arise out of or is in connection with our agreements, services and websites, or related thereto, whether directly or indirectly. If the dispute is not resolved by negotiation, you agree to resort to mediation before going to court.

 

APPLICABLE LAW AND JURISDICTION

 

Our proposals, agreements and overall relations with you shall be governed by and construed according to Greek Law. Any dispute arising out of or is in connection with our proposals, agreements, services and websites, or related thereto, whether directly or indirectly, and is not resolved by way of negotiation or mediation, shall be settled through legal proceedings conducted in the competent Court of Athens, Greece, without giving effect to any conflict of laws rules.

Key rights under Directive (EU) 2015/2302

Travelers will receive all essential information about the package before concluding the package travel contract.
 — There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
 — Travelers are given an emergency telephone number or details of a contact point where they can get in touch with the organizer or the travel agent.
 — Travelers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
 — The price of the package may only be increased if specific costs rise (for instance, fuel prices) and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8 % of the price of the package, the traveler may terminate the contract. If the organizer reserves the right to a price increase, the traveler has a right to a price reduction if there is a decrease in the relevant costs.
 — Travelers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travelers are entitled to a refund and compensation where appropriate.
 — Travelers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
 — Additionally, travelers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee.
 — If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveler at no extra cost. Travelers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organizer fails to remedy the problem.
 — Travelers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.
 — The organizer has to provide assistance if the traveler is in difficulty.
